finance
We have specialist Counsel available to advise in the complex and increasingly specialised area of resolving disputes concerning the finances and property of separating or divorcing couples, married, cohabiting and civil partners.
Specialists in disputes under financial law
Our financial law specialists deal with claims for ancillary relief involving very substantial assets, including farms, issues relating to holdings in private companies, and disputes about interests in trusts and pension provision.
We are frequently instructed to act in cases to prevent the dissipation of assets or to secure the enforcement of orders of the court and the regulation of the use and occupation of property. Disputes dealt with also involve cases in which the assets that the court has to allocate are insufficient to provide for the parties and their children, including those cases that feature insolvency.
Cohabitation and civil partnership law
We are regularly asked to advise and appear in disputes between cohabiting partners where complicated arguments about co-ownership of assets and trust law are of great importance. We also act in cases brought under the Inheritance (Provision for Family and Dependents) Act 1975 and applications for financial provision under Schedule 1 of the Children Act 1989.
